1. Acceptance of Terms

Welcome to Lust! By accessing or using the Lust website, applications, and services (collectively, the "Service"), offered by TopHouse ("TopHouse", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these User Agreement ("Agreement") and our Privacy Policy, incorporated herein by reference.

Please read this Agreement carefully before using the Service. If you do not agree to all of the terms and conditions of this Agreement, you must not access or use the Service.

2. Eligibility and Account Registration

2.1. Age Restriction. The Service and its content are intended for mature audiences and are strictly for individuals who are at least 18 years of age or the age of majority in their jurisdiction, whichever is higher. By using the Service, you represent and warrant that you meet this age requirement.

2.2. Geographic Restrictions. Access to and use of the Service is prohibited in certain jurisdictions where adult or sexually explicit content is illegal. These territories include, but are not limited to, China, North Korea, Iran, Saudi Arabia, United Arab Emirates, Pakistan, Bangladesh, Indonesia, Vietnam, and other countries with similar legal restrictions. By using the Service, you represent and warrant that you are not located in, under the control of, or a national or resident of any such prohibited territory, and you agree not to use or attempt to use the Service while located in any such territory.

2.3. Account Creation. To access certain features of the Service, you may be required to create an account ("Account"). You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.4. Account Security. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized access to or use of your Account. TopHouse will not be liable for any loss or damage arising from your failure to protect your Account information.

2.5. Account Termination. We reserve the right to suspend or terminate your Account at any time for any reason, including, but not limited to, violation of this Agreement. You may also terminate your Account at any time by following the instructions on the Service.

3. Content Disclaimer

You acknowledge and agree to the following regarding the content available on the Service:

• Fictional Nature: All characters, events, and incidents depicted in the Games available on the Service are entirely fictional. Any resemblance to actual persons, living or dead, or actual events is purely coincidental.
• Age of Characters: All characters depicted in sexually explicit content are 18 years of age or older.
• Mature Themes: The content of the Games may contain explicit and mature themes, including but not limited to: graphic sexual scenes, nudity, BDSM, fantasy violence, and other adult-oriented subjects. Viewer discretion is advised. By accessing the content, you affirm that you are not offended by such material.

4. Service Description

Lust is an online platform that distributes digital games and related content ("Games"). The Service offers:

• 4.1. Game Purchases. You can purchase Games using Gold (as defined below). Purchased Games may be available for download to your computer and/or playable online via web browsers, depending on the Game.
• 4.2. Gold. The Service uses a virtual currency (“Gold") which can be purchased with real money. Gold is used to purchase Games, Subscriptions, and In-Game Items within the Service. Gold has no real-world monetary value and cannot be exchanged for real money, except as may be required by applicable law.
• 4.3. Subscription Service. Lust offers a subscription service ("Subscription") that provides access to a library of Games and/or other privileges. Subscriptions can be purchased and renewed using Gold. The specific benefits and terms of the Subscription will be detailed at the time of purchase.
• 4.4. In-Game Purchases. Certain Games may offer the option to purchase virtual items, enhancements, or other content within the Game ("In-Game Items") using Gold.
• 4.5. Content Rating. The Games available on the Service contain mature content, including sexual themes, violence, and other adult topics. By using the Service, you acknowledge that you may be exposed to content that you find offensive or inappropriate. We may provide content ratings or labels, but you are solely responsible for determining whether the content is suitable for you.

5. Payments and Gold

5.1. Purchasing Gold. You can purchase Gold through the payment methods offered on the Service. By purchasing Gold, you agree to pay the applicable price and any associated fees or taxes. All payments are processed by our third-party payment processors, and you agree to their terms and conditions as well.

5.2. Gold Balance. Your Gold balance will be credited to your Account upon successful payment. You can view your Gold balance in your Account settings.

5.3. Non-Refundable Purchases. Purchases of Gold, Games, Subscriptions, and In-Game Items are generally non-refundable, except as may be required by applicable law or as explicitly stated in our Refund Policy (if applicable).

5.4. Subscription Renewals. Subscriptions may automatically renew unless you cancel them before the renewal date. Renewal fees will be deducted from your Gold balance or charged to your designated payment method if your Gold balance is insufficient. You can manage your Subscription renewals in your Account settings.

5.5. Changes to Prices. We reserve the right to change the prices of Gold, Games, Subscriptions, and In-Game Items at any time without prior notice. Such changes will not affect purchases made before the price change.

6. License and Restrictions

6.1. License to Use the Service. Subject to your compliance with this Agreement, TopHouse grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial entertainment purposes.

6.2. License to Games. When you purchase a Game, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Game for your personal, non-commercial entertainment purposes, subject to the terms and conditions of this Agreement and any additional terms provided with the Game. You do not acquire ownership of the Game itself.

6.3. Restrictions. You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Allow or enable any individual under the age of 18, or the legal age of majority in their jurisdiction, to access or use the Service or your Account.
• Attempt to circumvent or bypass any age verification systems or other access control measures on the Service.
• Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Service or any Game, except as expressly permitted by applicable law.
• Distribute, sublicense, rent, lease, lend, sell, resell, or otherwise transfer or make available the Service or any Game content outside of the channels expressly permitted by TopHouse.
• Interfere with or disrupt the operation of the Service or the servers or networks connected to the Service.
• Attempt to gain unauthorized access to the Service or any part thereof, other accounts, computer systems or networks connected to the Service.
• Use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission.
• Circumvent, disable, or otherwise interfere with security-related features of the Service or features that prevent or restrict use or copying of any content.
• Engage in any conduct that could be considered offensive, harmful, or inappropriate, including, but not limited to, harassment, bullying, or spamming other users.

7. User Content

7.1. User Content Definition. The Service may allow you to create, upload, post, or otherwise make available content, such as profiles, comments, messages, or other materials ("User Content").

7.2. Responsibility for User Content. You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that your User Content does not violate this Agreement, any applicable laws, or the rights of any third party.

7.3. License to User Content. By submitting User Content to the Service, you grant TopHouse a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Service and TopHouse's business, including for promotional and marketing purposes.

7.4. Content Moderation. We have the right, but not the obligation, to monitor, review, edit, remove, or refuse to post any User Content that we believe violates this Agreement, is offensive, illegal, or otherwise objectionable.

8. Intellectual Property

8.1. Service Ownership. The Service and its original content, features, and functionality (including, but not limited to, text, graphics, logos, icons, images, audio clips, video clips, software, and data compilations) are and will remain the exclusive property of TopHouse and its licensors, and are protected by copyright, trademark, and other intellectual property laws.

8.2. Game Ownership. Games distributed through the Service are the property of their respective developers and publishers and are protected by copyright and other intellectual property laws. Your rights to use Games are limited to the licenses granted in this Agreement.

8.3. Trademarks. Lust and TopHouse logos and names are trademarks of TopHouse. All other trademarks, service marks, and logos used on the Service are the property of their respective owners.

9. Termination

9.1. Termination by You. You may terminate your Account at any time by following the instructions on the Service.

9.2. Termination by Us. We may terminate or suspend your Account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement.

9.3. Effect of Termination. Upon termination of your Account, your right to use the Service will cease immediately. Your Gold balance may be forfeited upon termination, unless otherwise required by applicable law. Provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT, GAMES, AND IN-GAME ITEMS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
TOPHOUSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE AND ANY GAMES IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOPHOUSE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, ANY GAMES, OR THIS AGREEMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF TOPHOUSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL TOPHOUSE'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THIS AGREEMENT EXCEED THE AMOUNT YOU HAVE PAID TO TOPHOUSE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless TopHouse, its affiliates, directors, officers, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of this Agreement; or (d) your violation of any rights of another.

13. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.
Any dispute arising out of or relating to this Agreement shall be resolved through the courts of the Republic of Serbia.

14. Changes to this Agreement

We reserve the right to modify or revise this Agreement at any time by posting the updated Agreement on the Service. Your continued use of the Service after the posting of any changes constitutes acceptance of those changes. We encourage you to periodically review this Agreement for any updates or changes.

15. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and TopHouse regarding the Service and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and TopHouse.
